These Terms and Conditions ("Terms") govern your use of our website and your purchase of products from our store, including preorders of the Hooded Seal Plush. By using our site or placing an order, you agree to these Terms. Please read them carefully. Nothing in these Terms affects your statutory rights as a consumer.

1. About Us

This website is operated by MOULD EFFECT LIMITED, a company registered in England and Wales under company number 09361697. In these Terms, "we", "us", and "our" refer to 'Steve Mould' and 'This is why it does that'.

We may update or change these Terms from time to time by posting the revised version on our website. The version that applies to your order is the one published here at the time you place it.

2. Eligibility

To place an order you must:

- be at least 18 years old; and
- provide accurate, complete, and current information at checkout.

Our products are toys and may be bought for use by children, but the account holder placing the order must be an adult.

3. Products and Preorders

- Descriptions. We take care to describe and picture our products accurately, including colour, size, and materials. Slight variations can occur, particularly with small-batch or handmade items, and on-screen colours may differ from the finished product. We may correct any errors in descriptions or pricing.
- Preorder. The Hooded Seal Plush is currently sold on a preorder basis. This means you are ordering an item that has not yet been produced or is not yet in stock. Production may depend on reaching a minimum number of orders, and any delivery date is an estimate. Full preorder terms are set out in section 5.
- Availability. All products are subject to availability. We may limit quantities or decline or cancel an order, for example, if an item is unavailable or there has been a genuine pricing error, and where we do, we will refund you in full.

4. Prices and Payment

- Prices are shown in pounds sterling (GBP) and, where applicable, include VAT. [If you sell in other currencies, the price and any taxes shown at checkout for your region will apply.]
- Delivery costs are shown separately at checkout before you pay.
- We accept payment through secure third-party payment providers. We do not receive or store your full card details.
- For preorders, payment is taken in full at the time you place your order.

5. Preorder Terms

By placing a preorder for the Hooded Seal Plush, you agree that:

- Conditional production. Production will only go ahead if a minimum number of preorders is reached. If that threshold is not met, we may cancel production and will refund all preorders in full.
- Estimated delivery. Any dispatch or delivery date we give is an estimate. It may change because of production, materials, or supplier delays. We will keep you updated and give you a revised timeframe if it changes.
- Your right to cancel is preserved. Because you are buying at a distance, you keep the statutory right to cancel described in section 7, including the right to cancel for a full refund if we do not deliver within the agreed period or, where none was agreed, within 30 days of your order.
- If we cancel the project. If we cancel production, you will receive a full refund to your original payment method.

6. Delivery

- We deliver to [the UK / the UK and selected international destinations]. Delivery costs and estimated timeframes are shown at checkout.
- Delivery estimates are not guarantees; delays can happen due to carriers, customs, or events outside our control.
- Risk in the goods passes to you when they are delivered. If a specific delivery date is essential to you, please tell us before ordering.
- International orders may be subject to import duties, taxes, and customs fees charged by the destination country. These are not included in the price or delivery charge and are the recipient's responsibility.

7. Cancellations, Returns and Refunds

Your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply to your purchase and are summarised below. Full details are in our [Refund Policy].

- 14-day right to cancel (distance sales). You may cancel your order for any reason from the moment you place it until 14 days after the day you (or someone you nominate) receive the goods. To cancel, tell us clearly within that period.
- Returning the goods. After cancelling, return the goods within 14 days. You are responsible for the return cost unless the item is faulty or not as described. Please return items unused and, where possible, in their original condition and packaging.
- Refunds. We will refund the price you paid plus standard delivery within 14 days of receiving the goods back (or of receiving proof that you have sent them). We may reduce a refund to reflect any loss in value caused by handling beyond what is necessary to examine the item.
- Faulty or misdescribed goods. If your item is faulty, damaged, or not as described, you have the right to reject it for a full refund within 30 days of receiving it, or to ask for a repair or replacement. Please contact us with photographs and we will put it right, including any return costs.
- Exceptions. The 14-day right to cancel does not apply to certain items, such as goods made to your specification or personalised, or sealed goods not suitable for return for health or hygiene reasons once unsealed.

8. Product Safety and Age Suitability

The Hooded Seal Plush is a toy.

- It is intended for age group 8+. Warning: not suitable for children under 36 months, small parts, choking hazard.
- Our toys are made to comply with the Toys (Safety) Regulations 2011 and carry the appropriate conformity marking.
- Please remove all packaging, tags, and fastenings before giving the toy to a child, and keep them out of reach.
- Adult supervision is recommended for young children.

Nothing in these Terms affects your legal rights if a product is unsafe.

9. Intellectual Property

All content on this website — including the Hooded Seal Plush design and artwork, product images, logos, and text — is owned by THE MOULD EFFECT LIMITED or its licensors and is protected by copyright, trade mark, and other laws. You may not copy, reproduce, distribute, or commercially exploit any of it without our written permission.

10. Our Liability

- We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill, but we are not responsible for loss or damage that is not foreseeable.
- We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence; for fraud or fraudulent misrepresentation; for breach of your statutory rights in relation to the goods; and for defective products under the Consumer Protection Act 1987.
- We are not liable for business losses. If you use a product for any commercial purpose, we will have no liability to you for loss of profit, loss of business, business interruption, or loss of business opportunity.
- Subject to the above, our total liability for any claim relating to a product will not exceed the price you paid for that product.

11. Third-Party Services

Our website uses third-party services such as payment processors and analytics providers. These have their own terms and privacy policies, which we recommend you review separately.

12. Events Outside Our Control

We are not liable for any failure or delay in meeting our obligations where that failure or delay results from events outside our reasonable control (for example, supply failures, industrial action, or extreme weather). If such an event affects a preorder, we will contact you with a revised timeframe or offer you a refund.

13. Governing Law

These Terms are governed by the law of England and Wales, and disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere, you continue to benefit from any mandatory consumer-protection rules of your country of residence.
